im in a abusive marriage and i want out of it imet a very nice guy that really accepts me and the kids he wants me to move to new jersey to get away from him i want to move now i was wondering is it illigal for me to move there while still married my husdand drinks all the time picks on me calls me names i cannot take it anymore i want to live in new jersey now if i left now woul;d there be any trouble my husband said over and over i could leave but i heard i could be charged with something if i left but i cant take living with him no more what can i do can i go ahead and go to new jersey he said he likes living alone i need an answer to this and make sure i wont get in no trouble if i moved how can i stay here with a drunk i got kids i met a really nice guy thats wiuling to take us in i need to know if i left ohio to move to new jersey i wont get charged with anything please get back with me ty

My suggestion to you is to protect youself and even more importantly, the kids. It is grounds for divorce to be absent for more than one year, but so is extreme cruelty. He may be "guilty" of extreme cruelty. Each of the parents has equal access to the kids absent a court order. Therefroe, unless he has filed for divorce, you may take the kids out of state.
