Legal Question in Family Law in Ohio

Divorce - Division of Property

My husband and I lived together for 1 1/2 before we were married and we were only married for 3 months before I left him. During the time we were together we built a new home ($266,000.00 with a $27,000 deposit). The house is not in either of our names but in my husband's father's because of poor credit issues. The money put down on the house before our marriage and after our marriage at closing came from our mutual bank account. Am I entitled to half of the value of the home?

Re: Divorce - Division of Property

You are definitely entitled to half of the downpayment. Only if you can conclusively establish the house as a martial asset, will you be entitled to half its value. The court must be made aware of all the facts and circumstances surrounding the house to make this determination.
