Legal Question in Family Law in Ohio

divorce

my father left my mom in 1969. they never filed for divorce.

he has lived with the other woman ever since. she has left

him and now needs continous care due to diabetes. he has

lost one leg and is about to lose the other. also his mind

is slowly slipping away. he will need constant nursing care.

my question is, is my mother legally able to make any of his

decisions for him or do we need to file guardianship papers?

Re: divorce

He is an adult. For your mother to make decisions on his behalf, either he must consent to granting her the power, or your mother will need to commence a guardianship proceeding.
