Possible Divorce

I have been married for 5 years and we have lived together for 11 years. We have a 3 year old daughter. My daughter and I moved out because he started a relationship with another woman. I am wondering if spousal support is possible, he makes twice what I do and because he has taken is income from us I am forced to live with relatives. Also will the fact that I moved out after hearing explicit voicemail messages from his girlfriend cause me a problem if I proceed with a divorce.

The court has broad discretion in issuing spousal support. If you file for divorce you can immediately ask for temporary spousal support and child support. The fact that you moved out after hearing explicit voicemail messages from his girlfriend will not cause you a problem if you proceed with a divorce.
