I and my estranged wife have lived apart and separate for 3 1/2 years now. I am filing for divorce. She is refusing to sign saying if she doesnt sign, we cant get divorced. She is the one who kicked me out of our home and cheated on me in our marraige now, she doesnt want to sign the papers since I have found someone after all these years who treats me good. She has also had a baby and has been living with her lover (from our marraige) sine she kicked me out and also had a baby by him. What can I do. I want this over with and I am tired of her wanting me to support her financially still. I have been paying child support since I moved for OUR 2 children and refuse to help her financially otherwise. (She refuses to work). Please, what does the law state as far as her refusing to sign the divorce papers? what are my rights?

In Ohio, the parties are untitled to a divorce after living separate and apart without cohabitation for one year, and there need not be any other ground for the divorce. Based on the fact that you have been apart for 3 1/2 years is enough reason to file without the other party's objection.
