I want to seek a Divorce from my husband We were married 24 years in Ohio. I now live in Richmond Va. I have lived here 10 months. Our assets are already divided and our children are grown. The only outstanding common debt we have is 2 more years on a chapter 13 Bancruptcy. The Bancruptcy is coming out of my personal checking account and i need him to pay his half. Can I still seek a dissolution? I was told he would have to start the paper work and he has not done so. What are my rights?

Because divorce involves the splitting of marital assets and liabilities, the court generally prefer to see a clean splitting. This means that they would like to see the Chapter 13 bankruptcy issues resolved or a clear sense of how they would be resolved in the near future. It sounds as though you are having problems with your spouse helping you meet the schedule of payments under Chapter 13. You should discuss your options with an attorney.
