Legal Question in Family Law in Ohio
Divorce in different state than married in
If a couple was married in one state and then later separated from each other but didn't get a legal separation or divorce in court, and then the husband disappeared about nine years ago so he would not have to pay child support, is it possible that the husband could have gotten a divorce from the wife in a different state without the wife's knowledge, and if it is possible would the wife have to seek the help of an attorney to do a search of divorce records from other states to find out?

It is possible that a party can get a divorce without the other spouse knowing about it. If a good faith effort is made to locate a spouse in a divorce proceeding, and they can't be located, then service is completed by publication. The easiest thing to do is get a divorce yourself. Since it will go uncontested, it should be fairly inexpensive, requiring only one in court hearing. Best regards, Edward DiCato

This is possible, but a remote possibility. Have you tried reporting him to the county prosecutor's office Child Enforcement Support section? They have ways of locating people that the average person doesn't.
