Legal Question in Family Law in Ohio

divorce after 14 yrs of not living together

My parents have been married for 29 yrs but living apart for 14 yrs. my dad left us for another woman but now is leaving his girlfriend and is in the proces of buying a house. If they get divorced, would my mom get half of it house? What about health ins. coverage? would he be liable to pay her anything? My dad has been giving my mom money every month in the form of a check, nothing legally filed. Would he still owe her alimony?

Re: divorce after 14 yrs of not living together

Your mother would be presumptively entitled to half the value of the house. If he is covering her presently with health insurance, he would have to maintain that coverage, but I do not believe that the court would order him to get new coverage for her on a temporary basis. Generally, after the divorce, he will not be required to cover her, unless she has preexisting or unusual health problems. Spousal support is available for either party, provided need or fault can be proven.
