domestic violence

My husband has been charged with domestic violence for hitting our son. I, his wife, am the petioner for my son. We want to drop the charges, but were told we can not. We do not want my husband to be charged with domestic violence. What can we do? What happens if we do not show up for the pre-trial?

The law is constructed in such a way that the victim cannot drop charges. If the victim backs away, the law allows the state to intervene. This is because victims are often frightened or intimidated into dropping charges by the time the hearing date comes around. If you both do not show, the case could be continued by the state. If you do show, you may be allowed to testify in his defense.
