Legal Question in Family Law in Ohio
Engagement ring rights
I asked my girlfriend to marry me on Sweetest Day in 2002. When she said yes, I put a ring on her finger. We are now splitting up and she says the ring is hers because I gave it to her on Sweetest Day. I say the ring was a promise to marry and since we are not getting married, then the ring goes back to me. It is an $11,000 ring and I still owe about $2500 on it. Who does the ring legally belong to? Thank you for your help.

Re: Engagement ring rights
Generally, the engagement ring is a gift conditioned upon marriage. Therefore, you should be able to get the ring back because you never got married. This may change from county to county, but here in the Cleveland area it is pretty well settled that save a couple of execeptions, you should get your ring back. Good luck.
