enrolling into school
My ex husband and I have joint custody with the minor child residing with me...as stated in our divorce. I live in Missouri and he lives in Ohio. He is trying to enroll her in school as she will be living with him for this year. The school will not accept her as the document states that she resides with me. Will a power of attorney for childcare do in this situation and if so, what is the exact form called as there are two listed on legalforms dot com for this purpose. Thank you.

My guess is that a motion or perhaps a letter to the court and approved by the court showing that the two parents agreed to the change of the residential parent will be accepted. I suggest asking the school what type of document would work. Also, what does your shared parenting plan say pertaining how you both will agree to any changes? This may seem straightforward to you, but what complicates matters, also, is that child support is affected. Will this change the child support arrangement?

What the school in Ohio requires will depend upon Ohio law. But, the Ohio attorney who responded brings up a good point. You may be well advised to have this situation, and the existing legal documents (Court Orders) reviewed. I believe that making sure to do things properly in the first plae, even if it costs a little money will be ineveryone's best interest and willsave eveyone money and trouble in the future. Using forms obtained via the internet without professional advise is not recommended. Good luck.
