Legal Question in Family Law in Ohio
false accusation of paternity
My nephew has been accused of being a father to a child for the past 15+ months of a child he has never seen. Today he found out that the child does not even exist, that the mother had an abortion without his knowledge. She has emailed fake pictures and countless emails to many people directly and indirectly involved with this matter. Now he wants to sue this girl for this harassment, Is it possible? And what grounds does this fall under? Both parties are over 21. This girl has already had an abortion with their first pregnancy which involved a set of twins. (This was without my nephews consent nor knowledge either) He has been tortured by this girl for a long time over this ''invisible baby'' for a long time now. He has no children of his own, which is why he desperately wanted this child to ''exist''. Please let us know if he can do anything legally possible to stop this girl from doing this awful, and evil act to anybody else again. Thank you!

Re: false accusation of paternity
Even assuming for the moment that there is a cause of action lurking out there somewhere, two things must be shown. He has been injured physically, mentally or emotionally. Then he needs someone to measure this damage and assess a monetary value to it! If the girl is rich and can cover all the expenses he will incur, then I am sure an attorney he finds will tell him the relative merits of his claim.
