Legal Question in Family Law in Ohio

I want the fastest, least expensive dissolution or divorce possible

My wife and I have been separated for 9 months. The

house is mine, a premarital assett, and beyond that,

there is little else to fight about except a few

material items, which she can have. Three part

question-how can I get the least expensive FASTEST

divorce or disolution possible, contested or

uncontested that is recoginized by the State of Ohio.

I simply want out. Is it possible to get a

legitimate, binding overnight divorce ANYWHERE that is

recoginized by Ohio? What claims, if any, does she

have o

As to price, a lawyer is not always necessary. Homemade separation agrements have been accepted by courts before. In the absence of a lawyer, all it will cost you is the filing fee, which will vary from court to court. Under the law, however, the shortest time you have between filing and trial is 42 days. As to other states, they all have their own residency requirements. Also, keep in mind that your wife must agree for the dissolution to work.

A valid divorce in another state is valid in Ohio, but each state has its own residency requirements. Look at Nevada. Rumor has it that it may be easier to get a divorce there. But, you will need your wifes agreement on the divorce for it to proceed quickly and for division of the property. While the house may be a premarital asset, the appreciation of the house during the marriage is a marital asset. If this is a short term marriage, the appreciation will be minimal.
