Legal Question in Family Law in Ohio
Father Unknown
I thought I was doing the right thing by putting myself down as the father of my now ex-wife's child. I didn't know she was pregnant by another man until 3 months into our marriage. I tried to save the marriage and provide the baby with a good father. The marriage failed anyway and now I pay child support. I love the little girl, but have serious misgivings about continued support for various reasons. I am the only father she has ever known and she doesn't know the truth. What are my rights to stop child support and continue to see her and my ''real'' daughter by her mother? I fear any action on my part will force the mother to keep me from seeing either of them. My lawyer in OH is aware that the child isn't mine, but has offered no help. We have been divorced for 5 years. Is there anything I can do to rectify this situation?

Unfortunately we handle only immigration cases in Ohio and Family law cases in Florida.

A DNA test is the only solution since you are not the biological father. In many instances, the mother is the one who must pay for these tests if it is contested. However, to avoid litigation, have your attorney prepare and file a Paternity Suit enforcing the parties (mother/father/child) to partake in this blood test (usual costs $400-$800)
