if i file for custody once the other party receives the papers can they take the child out of state?

In Ohio, once the other party has received the order of the Court, that party cannot disobey the court's orders without risking prosecution for or a finding of contempt of court upon motion. The answer to your specific question however depends upon what the court's initial orders stated. if the court did not impose a restriction on removing the children from the state, then there is nothing that prevents a parent from removing the children to another location.
