Legal Question in Family Law in Ohio
Gaurdian ad Litem in Ohio
1. My stepson was taken from his moms house at 19months due to severe neglect. My husband has custody. Mother was granted supervised visits-she never showed up for 4 years. He is now 8 years old and diagnosied with PDD (autisim).
2. I try to adopt my him-mother objects. Court decides there is not enough evidence to terminate her rights. She claimed we would not ''let'' her see him. (totally untrue, but anyhow...)
3. Mother now has unsupervised visits. Currently 12 hours, will be building up to Schedule A
4. Child complains he is not permitted to go inside their house--says it's a mess--even forced to go to the bathroom outside. In the cold and rain--they are outside. Also say's he ''watches brother when mom does things'' He cannot elaborate on ''thing'' because he has problems communicating.
5. We contact GAL and tell him, and he says its ''not his job to go there''?! We should instead try talking to mom. GAL should represent best interest of the child--he should know what's going on, right?
6. Mother has not returned our call. Will probably make excuses not to talk about it.
7. We fear for our child's safety and well-being in the mean time. What is GAL obligated to do? Should we call CSB? Police?

If you haven't done so, report this to your local children's protective services. The intake social worker may find enough evidence to make an appointment, interview mom, and inspect the home. If an incident occurs with the child that appears to be one of neglect, you can also call the police so that an incident report would be prepared. If the police find the situation serious enough, then the social service agency would be contacted. If there is enough evidence, then a court procedure will begin.
