Legal Question in Family Law in Ohio

holiday schedule

Shared Parenting schedule indicates for even years for the holiday:

mother 12/23 - 12/24 10:00 p.m.

father 12/24 - 12/25 9:00 p.m.

Also states: Holidays will take priority over any other visitation except birthdays.

Father says he will not return our 11 year old son to me on 12/25 at 9:00 p.m. because Wednesday (Christmas)falls on his day during the week in which he usually has him.

Doesn't the holiday take precedent so that I, the mother, can see him on Christmas at 9:00 p.m.???

Need your help please.

Re: holiday schedule

Most local rules for visitation (parenting time) provide that holiday visitation takes priority over regular visitation. If your current order has this provision then you will be able to file a contempt of court motion for noncompliance.
