Home Equity Scam

My husband refinanced our condo in 2004. I can not get information because the mortgage company says that he is the only person on this loan. They did tell me that if he defaults in his payment, it will go against him. My question is this, we purchased our condo at $83,000.00 over 5 years ago but I found out we owe almost $84,000.00 now. I think my husband has borowed against the equity without my knowledge. We are in divorce preceedings at this time. How can I find this information out if the mortgage company will not give me any information. I need an answer ASAP. Thank you.

You need to do a search of all filings for that permanent parcel number in the county recorders office to see if a new mortgage has been filed, and when.

Ask your attorney to get this information. All marital assets must be disclosed during a divorce proceeding. If you both boought the condo, it is a martial asset, even if your husband is reponsible for the debt.
