homemakers rights w/a dissolution
My husband and I are in the process of negotiating a dissolution. We have been together for 10 1/2 years, married almost 10, we are shy of 10 yrs marriage by 3 months. We have two children ages 6 and 9. We dont own a home. He makes about 38-40,000 a year. He has not been honest with his attorney about how much income he recieves, there for he is trying to get out of paying the right amount of child support, also he is claiming that I am not entitled to any spousal support at all. Throughout the length of the marriage , I havent worked out side of the home and I put off getting an education. I have a ninth grade education level with a GED. Would I be entitled to some sort of alimony?

It is imperative that each party honestly disclose each others income, assets, and liabilities. The rule of thumb is one year on alimony for 3 years of marriage. In your situation, the Court may order a longer period in order to allow you an opportunity to receive additional training. In order to get the right amount of income one indication is the tax return. Depending on the type of field he is in he may be making a substantial amount under the table. The exact amount of child support will be according to the child support guidelines.

Please remember that a dissolution is completely negotiated before submission to court. If he is unwilling to agree to spousal support, the only way to get it is to convert the dissolution to a divorce, and ask the court for it. It sounds like you need to dop that, if his disclosure is not a full one.
