Can my husband adopt my daughter?

My daughter is 11 years old. Her biological father has NEVER had contact, paid child support, and is not listed on her birth certificate. My husband wants to adopt her. Is this possible without having to contact her biological father? I feel it would be too hard on her to have to deal with him and I have no way of finding him. My husband adores my daughter and wants her to be his daughter too. Can we do this?

The biological father lost his rights after one year of no contact and no support. Your husband can adopt your daughter without the consent of the biological father. The Probate Court in your county is where you begin. Good luck!

Once the father has had absolutely no contact with the child for one year or more, the law states that he does not need to receive notice. However, you must complete an affidavit that you have made an effort to contact him. The local probate court is where to begin.
