I need more information to fully understand your situation. Are you living separate but still legally married? Are you planning on divorce?

Depending on the circumstances, you may need to file an action to determine parental rights/child custody. But this would be in the situation of living separate from each other.

If you are living together and legally married, then you may need to file for divorce, dissolution or legal separation and in that proceeding your's and your husband's parental rights would be determined as to the custody of your child.

If you'd like to discuss this further, feel free to contact me.
