Legal Question in Family Law in Ohio

My husband and I have been married for 61/2 years, have a 2 1/2 year old daughter. We are both unhappy in our marriage and decided we would seek counseling to see if our marriage could be saved, once we moved to our own place and secured health insurance. We were living with his parents due to economic hardship. He has now decided, quite abruptly to my knowledge, that he doesn't want to be married to me anymore and doesn't want to seek counseling. I am still in favor of counseling and staying together, especially since we have a child. He and his family have forced me out of the house because he doesn't want me there and the situation is making then "uncomfortable"and I have nowhere to go except my parents house 2 hours away. I am not, under any circumstance, leaving my child with him/them, which is what he wants me to do. I am now at my parents with her and seeking legal counsel. I am a stay at home Mom and he is leaving me in the lurch and thinks he will get custody of her. Help??!!

Sole custody of an infant with the father is highly unlikely. If you think that counseling or mediation is out of the question, you may want to file for divorce in order to get the protection that the court affords. I strongly suggest that you consult with an attorney.
