ex husband need to refinace

i'm in the process of selling and purchasing a ne home for me and my 2 kids. my credit report shows my name on a joint acct. that should have been refinance by ex-husband.

i had to refinance to get his name off the house me and my children received during the devorce. 3 years later i've moved on and he refuses to refinance, this has held up the process of purchasing a home. Can i take him to court,

and get my name off this loan. the loan is against 2 property he now owns.

If your husband was required by the terms of your divorce decree to be responsible for/refinance a debt, and he did not do it, he can be held in contempt by the court, and be made to pay the debt, and your attorney's fees. If the decree is silent, or if he made a good faith effort to refinance and failed, the court could still help to fashion a remedy.
