Legal Question in Family Law in Ohio
My husband is the residential parent of his son. The mother has visitation every Tuesday evening from 3:30pm-7:00pm and every other weekend. She also is granted 5 weeks visitation in the summer. He agreed to not order child support in exchange for "in-kind" contributions. She is responsible for 1/2 of unisured medical bills...Ok, not we are looking to relocate to Oregon. I have a job offer that is more than double my current income. My husband will be able to make a better living with more opportunity in Oregon. The educational system that the child will be in is higher ranked. The child is going to be 12 years old in a month and wants to go with us. We are willing to keep our home in Ohio for 1 year in the event that being away causes too much distress for the child (not likley). We are filing an Intent of Relocation tomarrow. I am wondering how long it will take to get a hearing scheduled and finished, as this relocation is based on a job offer. I am also wondering what the chances are that the court will deny us.
I would like to mention that my husband has no criminal record-the mother of the child has 3-4 misdemenor charges and 2 felony charges. The most recent being that she stole my husbands identity. She is on probation for 2 years currently. She doesn't pay 1/2 the medical bills and has never given 1 single in kind contribution. We are afraid that this will go on forever. Please advise. The length of time to get a hearing scheduled depends on how busy the court is. Every court is different. I really can't say for sure whether or not they would deny you. Every judge is different. However, it does sound like you have a good case.
Are you represented by an attorney? If not I suggest you retain one. I would be more than happy to do it and could develop legal arguments and strategies to deal with any opposition you will have from the mother.
