Legal Question in Family Law in Ohio

me and my husband were separated for 2 years we then were trying to reconcile when he just up and started dating one of my friends and moved in with her within days i went down and got dissalution papers and filled them out and gave them to him to look over and fill out his info and now everytime i try to get him to meet me to notorize them and make copies he ignores me it has been at least 6 months since i gave them to him i know somehow in his mind he thinks when him and her fall apart i am going to be there to pick up the pieces and get back with him and is never going to go through with the dissalution... so what i want to know is can i just actually sue him for divorce so i can get this over with but the other question i have is that seeings how i didnt go off with someone else and break our marriage i dont feel i should have to pay for it can i sue him for the costs and my attorney fees because not only did he start shacking up with someone new this time but that is why we split up the first time too

Yes, you can sue for divorce. Since he is committing adultery, you now have grounds. This can also be used to get the sympathy of the Court on your behalf. It is possible to request that he reimburse you for your attorney fees. I would need to know more to give you an idea of the chance of that. Under the circumstances, I think you could get a good settlement. Please feel free to contact me if you have further questions. Ed DiCato
