Your husband would need to file a motion in the court that has jurisdiction over the child support order (probably domestic relations or juvenile court depending on if he was married to his ex when his son was born). The mother would need to be notified that this motion was filed so she had an opportunity to present her side of the story. Your husband could either seek to terminate his parental rights or he could seek to enforce his visitation rights. But both would be taken care of in court and the mother would need to be notified.
