Legal Question in Family Law in Ohio
My name is Jessica and I'm turning 17 in December. I've been with a boy who is turning 18 in August for 4 years now, and just recently lost my virginity to him. Age of consent in Ohio is 16, but because my mom knows she wants to get a restraining order placed on him, but my father has sole custody and loves my boyfriend. Can she force a restraining order though I don't live with her? If so, can my dad fight it? What is the chances of getting it lifted?
1 Answer from Attorneys
In general there are two types of restraining orders in Ohio - domestic violence restraining orders and stalking or sexually oriented offense protection orders. Based on the facts you're provided, there doesn't appear to any cause for a court to issue either order.
Because there doesn't appear to be cause to issue such an order, any request for an order would be denied by the court.
To answer your questions:
1. The parent of a child can seek a domestic violence restraining order.
2. Anyone seeking (or opposing) a protection order will have a court hearing to support or oppose such a motion.
3. Based on the facts as you've provided, there doesn't appear to be reason for the court to even grant an order.
