Legal Question in Family Law in Ohio

leaving my husband taking his child to live out of statee

Im married i have 2 little boys one is from another relationship and the 1yr old is my husbands child.

he is a drunk and its hard i dont want to get a divorce because he will have right to see the baby and take for the weekends. My 1yrold doesnt go to any one but me. so I was wondering is it against the law to take my boys out of state to live if i have a job somewhere else?????

I juyst dont want him to be in there lives cause he is abusive to me and yells

You never kbnow how he will be.

I have already talked to battered women they said talk to a laywer. he is a drunk and good rarely.

I dont even want the 1yr old to grow up like that or my other son. He is nuts.

i just wonder is it ok to leave?????

The law states that both parents, absent a court order, have equal rights to the children. Therefore, as long as he does not file for divorce or custody of the child, you may be able to leave. However, you have to deal with the other child's father as you may need court permission to leave if the other father is involved with the child.
