Legal Guardianship of Grandson

I have been raising my 6 year old grandson since birth. My son (his father) and the mother were never married. I now want to seek legal guardianship. The mother is willing to sign papers but my son is not. He does not support him in any way. He may also be facing jail time and he does drugs. Can I get legal guardianship without him signing?

You might be able to considering that the child's mother is willing to consent, you have evidence that the child's father would be an unfit parent, and you have been the caregiver since he was born.This would be for the court to decide, but I suggest you try. It will make your job easier, and perhaps your grandson more secure.
