Who gets legal rights to a child if the parents are divorce, the mother has the legal right but dies, will that give the father legal rights over his children in Ohio?

Parents have equal legal custody rights to their child, unless there has been some other determination by a court. So the child would go to the father if the mother passes away. Please feel free to call if you have further questions. Ed DiCato
