Legal Question in Family Law in Ohio
Legally Seperated with child from another man
I have been legallyseperated from my husband for 2 years now. We filed for a divorce, but it hasn't been finalized. I got with a new man and got pregnant. He left me for another woman when I was 5 months pregnant. He doesn't want to believe that the baby is his. Since I am still considered legally married, I had to put my estranged husband on the birth certificate because it is the law in Ohio, even though he is not the father. I called my ex-boyfriend when I was in labor, and he didn't come down to see her be born, and still hasn't been ny to see her. He says he wants a paternity test done first, even though I know for a fact that he is the father. Just because he slutted around doesn't mean that I did it too. He said that if it is his child, that he wants 50/50 custody with her. How do I go about getting a paternity done to get my estranged husband off the birth certificate, and my ex put on? Once he finds out for sure that he is the father, does he really have a chance of 50/50 custody? I don't feel comfortable with his having my daughter 3 1/2 days a week. Since I plan on breast feedinf my child for 6 months, can the Judge order me to pump my milk? I seriously need advice!! Tamara

Re: Legally Seperated with child from another man
The boyfriend should be joined as a party in the pending divorce case. The Court would then order paternity testing.
