I live in Florida but want to divorce in Ohio
My husband is in the Air Force and we are stationed in Florida. Because we have purchased a home recently we both became legal residents. A few days ago he moved out stating the marriage was over. We have three kids and after school is over in May I am going to move back home to Ohio to be with my family. He is not fighting me on this. Can I divorce him from Ohio if he is living in Florida? Also what about child support and alimony and splitting of the assets and bills? I am trying to figure out what my best option is for getting the divorce and where it would be best for me to start the divorce. He has drained our bank account and we no longer have any money. What are my legal options with that also?

You can file for divorce in Ohio once you have become a resident of Ohio for a period of six months. If everything is agreed upon, usually you can get him to agree to the jurisdiction over this matter in Ohio in less than six months. You may want to hire an attorney in Ohio and one in Florida for the limited purpose of calculating his child support obligation. It should not cost you that much for such limited work. This will give you the best indication where you want the divorce to be handled. The other thought is that any future modification of child support or visitation will be handled in the state you get divorced (save some exceptions). You may want to keep that in mind in deciding where to file.
