Marital separation agreement

Hello,

I would like to know if it is necessary to have a marital separation agreement filed with a court. My husband and I have agreed upon an amount for spousal support and child support, as well as who will reside in the home.

If you both have gone this far with your arrangements, you may consider a dissolution rather than a divorce. Agreeing to dissolve the marriage legally will be a more secure arrangement than the one you have worked out.
