Legal Question in Family Law in Ohio

married still?

I have had no contact with spouse for approx. 10 years, address unknown. How do I find out whether I'm still married, and how do I get a divorce if I am? No children or property are involved.

Re: married still?

It is difficult to say if you are still married as your "wife" could have filed for divorce in any one of the 88 counties in Ohio or in any state in the United States. Therefore, it would be best to presume that you are married.

In order to obtain a divorce you will have to prepare the complaint and the other documents required by the Court, plus you will have to "publish" the complaint in a paper of general circulation. The clerk of Courts of your county will be able to tell you what newspapers qualify. Once the proper documentation is filed, the Court will set a hearing for the divorce. If she answers the complaint then the Court will treat the matter as they would any contested matter. In order to make sure that the proper documentation is filed, you should consult an attorney.
