Legal Question in Family Law in Ohio
If I have met and discussed to an attorney about divorcing my wife, but ended up retaining a different attorney can my wife use him
1 Answer from Attorneys
Once you have met with an attorney and revealed information about the case to him, that attorney could not represent the other party in the case. If that attorney were to attempt to represent your wife, your attorney could make a motion to disqualify that attorney.
The only exception might be if your "meeting" consisted of something where you sat down, the attorney said that it would cost $5000.00, you said that was too much, and then left. If the meeting were incredibly minimal like this, then a court might let the attorney represent the other side, but like I said above, if there were any details of the case discussed, then I think that the other attorney would have to step down.
