Legal Question in Family Law in Ohio

modification of visitation for older children

My ex wants full custody of my 3 daughters, ages 16 and 14. I have found out the girlfriend he is living with smokes pot and he lets my 16 year old daughters boyfriend spend the night. To me this is not right. Is this enough for a judge to modify his visits to no overnight visits? And he says because of the girls age they can come live with him and I can't stop them if they tell a judge. It is not in their best interest if he lets boy spend the night! Help!

Re: modification of visitation for older children

At approximately 12 to 13 years old the child can express an interest where he or she would like to live. However, the Court should look to the best interests of the children. You will need some rock solid proof that the girlfriend is smoking dope and the Dad is letting the girls sleep around. You are difinitely in an uphill battle

Good luck
