Legal Question in Family Law in Ohio

My mother in law is 62 years old, lives in ohio, and has been married for 14 years. Her husband is verbally and emotionally abusive. He has all of the property, cars,and accounts in his name only. If she leaves or files for divorce, is she entitled to anything? His property and home was his before they married but he makes in the range of $10,000 - $15,000 a month. He doesn't let her have any money and she now is cleaning apartments 1 day a week. Please answer as soon as possible as she is desperate for some knowledge about her rights. Thank you

Understand that victims of abuse are often afraid to upset the apple cart and often eager to forgive. They learn to accept the abuse. You might want to recommend to your mother to consult with an attorney so that she understands her legal rights in the event she is able to get the courage to confront the situation or to leave. In Ohio, common law marriages before Oct. 10, 1991 are grandfathered in as legal marriages and require that divorces be obtained. Common law marriage is no longer recognized in Ohio. You should consult with an attorney to see what applies to your situation.
