Mother left family, Father wants custody
Several months ago, my mother
decided to move out of the house
where I live with my father and my
11 year old brother and 16 year old
sister. Later we found out she had
been cheating on my father for over
a year. They are still married and she
lives with her boyfriend. She has
access to his money and often
spends it all on them and his
children, leaving my father and
siblings with nothing. He wants to
cut her off and get a divorce but is afraid he will not get custody of my
siblings, he thinks custody is never
given to the father. My siblings often
complain that her boyfriend and his
kids don't treat them well, they are
not abusive they are just mean and
bully them. However, my mother (a
larger woman) once sat on me for an
hour because I would not tell her a
story, and she bullies my bother. My
mother only works 16 hours a week
for an airline and my father works full
time from home. I am just trying to
help him. I heard in some places if
the mother leaves the family custody
automatically goes to the father.

The courts today favor shared parenting even when one parent is the custodial parent. If you dad can prove that it is better for the children that he is the residential parent, then this is very possible. I suggest he consult and attorney.
