Legal Question in Family Law in Ohio

Motion for Relief

While in the throws of moving out of state, and without legal representation because my divorce was final, I did not respond to my ex's allegation I was moving with furniture of his. My non-responsiveness landed me in Contempt of Court because I also missed the hearing. Mailings were going to old address & eventually forwarded to new address. I was told I was responsible for informing court of address change. However, children are grown & divorce is final. Without representation I didn't realize I was in a legal battle. Case for Motion for Relief?

Re: Motion for Relief

Yes or No!

How is that for a helpful answer?

Seriously, it depends on what the consequences were of you being determined to be in contempt. Were you fined? What did the Court order. If the remedy ordered by the Court was severe then you will need to get an attorney to plead your case to the Judge. It is certainl possible that the Judge will accept your explanation.

You should talk directly to an attorney soon. If you do not want to call the attorney who represented you in the divorce Give me a call and I will be happy to talk to you. No Charge or obligation for the confidential conference.

Good Luck!

Re: Motion for Relief

You need to consult with a local attorney to determine how much damage has been done that is irreversible. It may well be possible that, with good representation, the situation can be presented to the judge and things gotten back on track.
