how to obtain pension information from former spouse that spouse hid asset? The ex-spouse was required to set up a qdro per the divorce decree and refuses to divided the marital assets. Per the divorce decree the wife is owed 50 percent of all retirement related account from the ex-spouse.

the ex-spouse hid assets and now the ex-wife is unable to afford an attorney to pursue the matter and the ex-husband gets away with all the money and has possibly hid the money in his new wife's name.

In Ohio, the only way to force one individual to give another individual any information is through the court system. If there is already a case in which there is a ruling requiring husband to give assets to wife, then that case should be reopened and a motion to find the husband in contempt of court should be filed with the court. The wife could also file a motion to re open discovery, citing the information she has about hidden assets as a basis for that. If the court grants the motion, then the court can sanction the non disclosure if the husband continues to refuse to provide the information.

All of this can be done without an attorney, but of course an attorney's involvement is preferable. One of the sanctions that a court can impose upon the husband if he has engaged in wrongdoing of the type described would be to order him to pay attorney fees to the wife.

There are also Legal Aid Society type groups who will take on such causes for the poor, as well as law school clinics who can help free of charge.
