In Ohio, the Courts will divide up the assets and liabilities of the marriage. If the credit card debt was incurred during the marriage, it does not matter that the other spouse did not know about it. However, the Court is free to use its discretion to make up for the issue on the property settlement end if it wants to. But the general rule is that if the debt arose during the marriage, then it is proper to split it between the parties.
