Legal Question in Family Law in Ohio

I do not owe back cs but cs says otherwise

I paid my ex without going through child support

and now they say i owe a ton of back cs.

My ex agrees and has told them i do not owe it.

and i cannot afford a lawyer to fight this so

what can i do?

the kids are not even living with her.

First of all, you should have been advised that any payments to your Ex outside of CSEA is considered a gift. That aside you have a substantial problem. The question I have is was your Ex on welfare? If so, then she can not waive child support arrearages and as a matter of fact she would be liable in welfare fraud for collecting child support and welfare. If she was not on welfare then she is free to waive the child support arrearage. She just needs to go to CSEA and sign off on the amount allegedly due her.
