Past Due Child Support
I have been trying for the past 15+ years to collect past due child support payments from my former husband without any luck. We had four children together and our divorce was final in 1987. He resides in Ohio and I live in Kansas. As I understand it, unpaid child support still needs to be paid and is accruing interest to this day. I have been working with Kansas SRS but they have had no help from the state of Ohio. I don't understand why everyone agrees that the $60,000+ child support legally needs to be paid but nothing has ever been done. Three of the children would like to go to college now and the funds are needed. I have been the sole single parent raising this family for the past 21 years, always holding down 2-3 jobs, and feel I deserve the past due child support. Can anyone give me any suggestions?

If your former husband is employed, or has non-exempt assets, you may be able to hire an attorney on a contingency basis, where the attorney fees would come out of the recovery, if any. The suit could probably be filed in Kansas, if that is the home state for the divorce. If he appears to defend the suit, he may be in contempt of court if he is not paying court ordered support. If he does not appear and you have service of process, the you can probably obtain a default judgment which could be registered in Ohio where his wages may be subject to garnishment and non-exempt assets attached. I would refer you back to your divorce attorney since they would be familiar with the terms of your divorce and your individual situation.
