Legal Question in Family Law in Ohio

paternity affidavits

Can my husband sign a paternity affidavit for a child that he stated that might be his from a earlier relationship. Is it legal for him to sign a affidavit like that while being married with no say so of his spouse.I was under the impression that only single parents can do that.

Re: paternity affidavits

If he reasonably believes that the child is his, then there's bo legal impediment to doing it. A paternity determination has no legal efect on his spouse, therefore she has no standing to complain or intervene. I would get DNA testing if I were him, just to be sure.
