Paternity

I found out I was pregnant before my divorce was finalized. The child is most likely not my ex-husband's, the man I had an affair with is. Does the man I had the affair with have a good chance of getting the courts to grant him a paternity test?

To get the court to order a paternity test in the absence of your ex husband's agreement to same, the putative father must allege enough operative facts to show that around the time that you became pregnant, that there was no reasonable way that your ex husband could have been the father. He must be very specific to overcome the presumption of fatherhood provided by marriage.
