paternity home testing

is it legal to do a home dna paternity test without the consent of the mother even though you have the consent of the alleged father? (the alleged father and baby would be tested)

It is legal as long as you do not injure the child to do the test, but without the mother the test may not be very definitive. Also, since it is a home test, the reliability may come into question.
