Legal Question in Family Law in Ohio

What is the penalty in Ohio if a mother threatens to throw her daughter off a bridge if the father attempts custody? She has already threatened to kill the father of her son if he attempts custody. She also tried to kill the boy in utero before he was born.

In Ohio, there are no "penalties" for this sort of thing unless an individual can be shown to have violated a criminal statute. Whether her threats amount to that or not is hard to say because I don't know the context or whether or not they are conditional.

However, if you are concerned for the safety of the child, you can file an ex parte motion for emergency custody, attaching an affidavit featuring your concerns and the court may grant you temporary custody until the matter can be sorted out.

You should involve an attorney in this process and that would best be accomplished by consulting with your local county or city bar association and getting a referral to an attorney who practices in the family law area.
