pretrial deadline
hello. I am involved in a custody case in which i am acting in my own behalf, not represented by ana ttorney. WE had a pretrial conference a few weeks ago where the judge set a date for a final pretrial and later a hearing on a motion i filed for modification of an existing custody order, and she set a deadline for me to exchange witness lists with the other's attorney, and he has not met the deadline, i did, it's been 4 days, including sat and sun since the deadline, he has not filed with the court ofr an extension, these people have asked the court previously for attorneys fees and relief in law and equity on a former motion that i filed which was not timely and had a point of error, these are people who have brutally used their money and influence to keep my child, against my wishes, who is 7 y/o and this has been going on for four almost five years, I have been fighting them, my question is should i file a motion to hold the attorney in contemp of court? or would that appear frivolous? they would do it to me, in my opinion...

If counsel has failed to timely file his witness list, you can object at trial to him having any witnesses at all, other than his client. He is also in contempt, but I would expect him to have all documents by the time of trial.
