privacy rights

is a video tape of spouse using illegal drugs such as marijuana submissable in a court of law? with out his knowledge of him being taped?

Re: privacy rights

It is admissible if it is probative as to a major issue of the divorce, and that probative value is deemed by the judge to outweigh the prejudicial nature of showing his performing illegal conduct.
