Legal Question in Family Law in Ohio
reallocation of child custody
In the process of my divorce, my husband wanted full custody of our daughter. After a lengthly Guardian-ad-Litem (GAL) investigation, I was ordered full legal and physical custody of her. This was in 2003. Aprx. 1 yr. ago, he filed a 2nd motion for reallocation of custody. After a grueling 1 year of GAL's, MD;s, Psych evals...And many court dates, the Magistrate ruled in my ex-husbands favor. Not only did he get full psysical custody, he got full LEGAL custody. I have NO say in my child's life. Here's the thing...during BOTH investigations, I was and am currently on SSDI. Absolutley nothing has changed since the 1st GAL investigation, except for the fact that I am now married to a gainfully employed wonderful man who is active in his family and community, and has no criminal record ! I was told by the court ordered psychiatrist the she does not believe that someone with my disability can raise a child. The judge agreed. As of June 13th '08, I must surrender our daughter to him. That's it. ten years of being a housewife and Mother, a child with 4.0 GPA since kindergarten, healthy, happy, smart, well adjusted. Literally, at my side since birth. I have 2 days to appeal. Can't afford an attorney. Please help... Michelle

Have you considered contacting Legal Aid in your area or possibly there is a family law clinic at a law school in your area?
